fatal error in load.php before fresh installation

Monday i tried to install a wordpress site on a domain, running PHP 5.3 and mySQL 5.1 and downloaded the newest wordpress release, i keep running into the following message

Fatal error: Cannot use [] for reading in /public/sites//wp-includes/load.php on line 508

where the is where the real link appears but for reasons i took it out.
